Welcome to No Limit Performance (nolimitperformance.pk). These Terms & Conditions (“Terms”) govern your access to and use of our website and your purchase of auto parts, car accessories, and car care/detailing products from our online store and physical shop.

By accessing our website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use our website or services.

These Terms constitute a legally binding agreement between you (“the Customer”) and No Limit Performance (“the Seller”), a sole proprietorship operated by Khaliq Noor Afridi, located at Shop No. 16, Al-Mansoor Plaza, F-10 Markaz, F-10/4, Islamabad, Pakistan.

2. Eligibility

To make a purchase on our website, you must:

• Be at least 18 years of age or have the consent of a parent or guardian.
• Be legally capable of entering into binding contracts under the Contract Act 1872.
• Have a valid shipping address within Pakistan.

3. Account & Order Information

• Account Security: If you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
• Accurate Information: You agree to provide current, complete, and accurate information for all orders and account registrations. This includes your full name, correct shipping address, working phone number, and valid email address.
• Consequences of Inaccuracy: We reserve the right to cancel orders, refuse service, or suspend accounts if we determine that provided information is inaccurate, incomplete, or fraudulent.

4. Products, Descriptions & Pricing

4.1 Product Descriptions

We make every effort to describe our products accurately on our website. However:

• Images are for illustrative purposes only. Actual product appearance, packaging, or labeling may vary slightly from what is shown.
• Product specifications (dimensions, weight, material) are provided by manufacturers and are believed to be accurate but are not independently verified by us for every listing.

4.2 Parts Compatibility

It is your responsibility to ensure that the auto parts or accessories you purchase are compatible with your specific vehicle make, model, year, and engine variant. We strongly recommend:

• Verifying part numbers against your vehicle’s service manual or existing parts before ordering.
• Consulting with a qualified mechanic if you are unsure about fitment.

We cannot be held liable for parts ordered that do not fit your vehicle if you did not verify compatibility before purchase.

4.3 Pricing

• All prices on our website are listed in Pakistani Rupees (PKR) and are inclusive of the product price only (shipping charges and COD fees, if applicable, are added separately).
• We reserve the right to update prices at any time without prior notice. However, the price confirmed at the time of your order placement will be honored for that specific order.
• In the rare event of a pricing error (e.g., a product listed at Rs. 50 instead of Rs. 5,000 due to a system error), we reserve the right to cancel the order and notify you, offering the option to repurchase at the correct price.

5. Order Acceptance & Cancellation

5.1 Order Acceptance

• Placing an order on our website constitutes an offer to purchase. Your receipt of an order confirmation email or SMS does not signify our final acceptance of the order.
• We reserve the right to accept or decline any order for reasons including: out-of-stock items, pricing errors, suspected fraudulent activity, inability to deliver to your area, or inability to verify your information.
• An order is considered final and binding once it has been dispatched.

5.2 Cancellation by Customer

• You may cancel your order before it is dispatched by contacting us immediately at 0334 5353153 or info@nolimitperformancepk.com.
• If you paid in advance via Bank Transfer, Easypaisa, or JazzCash, a full refund will be issued to your original payment method within [CONFIRM WITH CLIENT] (suggested: 5-7 business days).
• Once an order is dispatched, it cannot be canceled — please refer to our Return & Exchange Policy.

5.3 Cancellation by Us

We may cancel an order at any point before delivery if:

• The product is out of stock or discontinued.
• A significant pricing or product description error is discovered.
• Fraudulent or suspicious activity is detected.
• Delivery to your specified location is not feasible.

In all such cases, you will be notified promptly, and any payment already made will be refunded in full.

6. Payment Terms

We accept the following payment methods:

• For advance payments (Bank Transfer, Easypaisa, JazzCash), your order will be processed after confirmation of payment receipt. Please share the transaction screenshot or reference number with us for faster processing.

7. Intellectual Property

• All content on nolimitperformance.pk — including but not limited to text, product descriptions, photographs, graphics, logos, the “No Limit Performance” name and branding, page layout, and software — is the property of No Limit Performance or its respective content suppliers and brand owners.
• You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of our website content for any commercial purpose without our express written consent.
• Product names and brand logos displayed on our website belong to their respective manufacturers and are used solely for product identification purposes.

8. Prohibited Uses

You agree not to use our website:

• For any unlawful purpose or in violation of any local, provincial, or federal law of Pakistan.
• To submit false, misleading, or fraudulent orders or information.
• To impersonate another person or entity.
• To upload, transmit, or distribute viruses, malware, or any other harmful code.

9. Limitation of Liability

To the maximum extent permitted by the laws of Pakistan:

• No Limit Performance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, your purchase of products, or your inability to use our services.
• Auto Parts Installation & Use: No Limit Performance is a retailer, not a manufacturer or an auto repair shop. We strongly advise that all auto parts, accessories, and modification products be installed by a qualified, certified professional mechanic. We expressly disclaim all liability for:
  • Damage to your vehicle resulting from improper or unprofessional installation.
  • Personal injury or property damage caused by misuse, improper handling, or installation of products.
  • Any loss arising from parts incompatibility where the customer did not verify fitment before purchase.
  • Consequential damages such as engine failure, accident costs, or towing expenses.
• Our total liability for any claim arising from a product purchased from us shall not exceed the purchase price you paid for that specific product.

10. Warranty Disclaimers

• Manufacturer Warranties: Many products we sell carry a manufacturer’s warranty. These warranties are provided by the original manufacturer, not by No Limit Performance. Warranty terms, duration, and coverage vary by brand and product. We will assist you in facilitating warranty claims with the manufacturer where possible.
• Retailer’s Position: As a retailer, No Limit Performance does not provide independent warranties on the products we sell unless explicitly stated on a product listing. Products are sold subject to their manufacturer’s specifications and warranty terms.
• What Warranties Do NOT Cover: Manufacturer warranties generally do not cover damage resulting from improper installation, misuse, modification, normal wear and tear, accidents, or use of the product in a manner inconsistent with the manufacturer’s instructions.
• Statutory Rights: Nothing in these Terms is intended to limit your statutory rights under the Islamabad Consumer Protection Act 1995 (as amended), including your right to remedy for defective goods or goods that are not as described.

Our website may contain links to external websites (e.g., manufacturer product pages, courier tracking portals). These links are provided for convenience only. We do not control or endorse the content of third-party websites and are not responsible for their privacy practices or content.

12. Governing Law

These Terms & Conditions are governed by and shall be construed in accordance with the laws of the Islamic Republic of Pakistan, including but not limited to:

• The Contract Act 1872
• The Sale of Goods Act 1930
• The Electronic Transactions Ordinance (ETO) 2002
• The Islamabad Consumer Protection Act 1995 (as amended in 2020)
• The Prevention of Electronic Crimes Act (PECA) 2016

13. Dispute Resolution

We value our customers and prefer to resolve any issues through direct, amicable communication:

2. Step 2 — Formal Written Complaint: If the issue remains unresolved, you may submit a formal written complaint to our business address.
3. Step 3 — Consumer Court: If an amicable resolution cannot be reached, you have the right to file a complaint with the Consumer Protection Court in Islamabad, which has jurisdiction over disputes involving products or services provided by businesses operating in the Islamabad Capital Territory. No court fee is typically required to file a consumer complaint.

The exclusive jurisdiction for any legal proceedings shall be the competent courts in Islamabad, Pakistan.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective when posted on this page with an updated “Last Updated” date. Your continued use of the website after changes constitutes acceptance of the revised Terms.
